These Terms of Service ("Terms") govern your access to and use of Setkin and our website, user panel, admin panel, and mobile application (together, "the Platform"). By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform. If you use the Platform on behalf of a business, you represent that you have authority to bind that business, and "you" includes that business.
1. Eligibility and acceptance
You must be at least 16 years old to use the Platform. By using the Platform, you confirm that you meet this requirement, that you have the legal capacity to enter into these Terms, and that you are not barred from using the Platform under any applicable law. If you are using the Platform on behalf of a business, you confirm that you are authorised to bind that business to these Terms.
2. The service
Setkin provides tools that help service businesses: collect, manage, and display verified customer reviews; verify reviewer identities by email code; publish a public profile page with a QR code and shareable link; calculate a TrustScore; and manage subscriptions, teams, and notifications. The service is offered on Free, Pro, and Teams plans. We may change, add, or remove features at any time.
3. Your account
You must provide accurate, current information when you create an account, and keep it up to date. You are responsible for keeping your password and any authentication devices secure, and for all activity that happens under your account. Notify us immediately at [email protected] if you suspect unauthorised access. We may suspend or terminate an account that we reasonably believe has been compromised.
4. Contractor responsibilities
If you use the Platform as a business: you must only invite customers who have genuinely transacted with you; you must not submit, encourage, or offer any incentive for a fake, misleading, or otherwise inauthentic review; you must not attempt to manipulate TrustScore or any reputation metric; you must not use the Platform to harass, defame, or mislead; you must comply with all applicable consumer protection and advertising laws in your jurisdiction, including the ASA/CAP Code in the UK, the FTC Act in the US, and equivalent rules elsewhere; and you must not use the Platform to collect reviews for a business you do not own or legitimately represent.
5. Reviewer conduct
If you submit a review as a customer: one review per completed job or visit; your review must reflect your genuine experience; you must not include illegal content, threats, or another person's private information; you must not impersonate another person; you must complete the email verification step — a review without a verified email address cannot be published; and you must not submit a review in exchange for payment or any other incentive unless that is clearly disclosed. Reviews are submitted on the understanding that they will be publicly displayed on the business's public profile page.
6. Prohibited conduct
You agree not to: scrape, crawl, or otherwise systematically extract data from the Platform without our written permission; attempt to reverse engineer, decompile, or otherwise derive source code from the Platform; interfere with or disrupt the service or its infrastructure; access another user's account without permission; upload malware or any harmful code; use automated tools to submit reviews, create accounts, or inflate TrustScore; use the Platform to harass, defame, or infringe the rights of any other person; use the Platform to violate any applicable law; or use the Platform in any way that could damage, disable, overburden, or impair it.
7. Subscriptions and payment
Free plans are offered at no cost. Pro and Teams plans are paid subscriptions billed monthly or annually in advance through Stripe. Prices are shown in the Platform currency at the time of purchase and may change on renewal. Subscriptions renew automatically until cancelled. You can cancel any time from the Billing screen of your Settings. If you cancel, you retain access until the end of the current billing period. We do not store your card details; Stripe handles payment data under its own terms.
8. Refunds
If you are not satisfied, contact [email protected] within 14 days of your first paid charge for a full refund of that charge. Renewal charges are non-refundable except where required by law (including, in the EU and UK, any statutory right of withdrawal that applies to digital services where you have waived it at checkout). We will always honour the statutory rights you have under the consumer law of your country of residence.
9. Free trials and promotional offers
We may offer free trials or promotional pricing. Where a free trial is offered, we will disclose at sign-up when it ends and what it converts to. If you do not cancel before the trial ends, you authorise us to charge the applicable subscription fee at the standard rate. Promotional rates may be time-limited and are not guaranteed to renew at the same price.
10. Intellectual property
The Setkin Platform — including its code, design, logos, TrustScore methodology, and documentation — is owned by Setkin and protected by intellectual property law. Your business content (name, logo, bio, photos, and reviews you receive) remains yours. You grant us a limited, non-exclusive, royalty-free licence to host, display, and distribute that content as part of operating the Platform. This licence ends when you delete the content or close your account, except to the extent we are required to retain it by law.
11. Content you submit
You are responsible for any content you submit, including reviews, replies, photographs, and support messages. You confirm you have the right to share it. You grant Setkin a worldwide, royalty-free, non-exclusive licence to store, display, and reproduce your content for the purpose of operating the Platform and promoting the service (for example, showing aggregate ratings on our homepage). You agree not to submit content that is unlawful, defamatory, obscene, or infringing.
12. DMCA and copyright complaints
If you believe content on the Platform infringes your copyright, contact our designated agent at [email protected] with the information required by the Digital Millennium Copyright Act (DMCA) or the equivalent law in your jurisdiction. We will respond promptly, including removing or disabling access to the material where appropriate. We may terminate the accounts of repeat infringers.
13. Disclaimer of warranties
The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. TrustScore is a proprietary metric and is not a guarantee of quality. Nothing on the Platform constitutes legal, financial, medical, or other professional advice.
14. Limitation of liability
To the fullest extent permitted by law, Setkin is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to these Terms or the Platform. Our total aggregate liability for any claim arising out of or relating to these Terms or the Platform is limited to the greater of: (a) the amount you paid us in the 12 months preceding the claim; or (b) £100. Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation. If you are a consumer, this clause does not affect your statutory rights.
15. Indemnification
You agree to indemnify, defend, and hold harmless Setkin and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: your access to or use of the Platform; your violation of these Terms; your violation of any third-party right, including intellectual property or privacy rights; or any content you submit to the Platform.
16. Suspension and termination
You may close your account at any time from the Settings screen. We may suspend or terminate an account that violates these Terms, that presents a security risk, that we are required by law to remove, or that has been inactive for an extended period. On termination, your right to access the Platform ends. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.
17. Governing law
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. If you are a consumer resident in the EU, the UK, or another jurisdiction whose consumer law gives you the right to bring proceedings in your country of residence, that right is not affected. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
18. Dispute resolution
If you have a dispute with Setkin, please contact us first at [email protected] — most issues can be resolved informally. If we cannot resolve it, the courts of England and Wales have exclusive jurisdiction, except where local consumer law gives you the right to bring proceedings in your own country. Nothing in this clause prevents either party from seeking urgent injunctive relief in any court of competent jurisdiction.
19. Class action waiver (US users)
To the fullest extent permitted by law, you and Setkin agree that any dispute will be resolved on an individual basis and not as part of a class, collective, or representative action. This clause does not apply where prohibited by law, including in jurisdictions that do not enforce class action waivers.
20. Export and sanctions compliance
You may not use the Platform if you are located in, or a national of, a country subject to comprehensive trade sanctions, or if you are on any list of prohibited or restricted parties. You agree to comply with all applicable export control and sanctions laws.
21. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email or by a prominent notice before they take effect. Continued use of the Platform after the effective date means you accept the updated Terms. If you do not agree, you must stop using the Platform.
22. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Setkin regarding the Platform. You may not assign these Terms without our written consent; we may assign them in connection with a corporate transaction.
